DMCA & Copyright Takedown Policy

Muse AI (“Muse,” “we,” “us,” or “our”) respects the intellectual property rights of creators, copyright holders, and content owners. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and international copyright laws, we will respond expeditiously and appropriately to notices of alleged copyright infringement.
1. Muse's Relationship to Copyright
A. Service Description & Fair Use
Muse operates as an analytical and educational utility that:
- Processes publicly available video URLs (from Instagram, YouTube, Threads) to compute engagement metrics, pacing analysis, and structural recommendations
- Accepts user-submitted video files to perform frame-by-frame analysis and generate optimization suggestions
- Generates original scripts, hooks, captions, and recommendations based on user input
Muse does not:
- Host, re-stream, re-publish, or sell full third-party video files
- Display copyrighted videos in their entirety without authorization
- Store or cache video content beyond the duration necessary for analysis
- Distribute third-party copyrighted content to other users
B. Safe Harbor Claim
Muse claims protection under DMCA Safe Harbor provisions (17 U.S.C. § 512) for the following reasons:
- Transient Storage: Any video data cached during analysis is temporary and automatically deleted within 24 hours
- System Caching: Public profile metrics from social platforms are cached for up to 24 hours to reduce API load, not for profit or content distribution
- User-Directed Links: Muse does not store or host user-uploaded videos; we process and analyze them at the user's direction and delete them upon analysis completion
- Lack of Knowledge: Muse exercises reasonable efforts to identify and remove infringing content when notified
- Responsive Takedown: We maintain procedures to expeditiously remove or disable access to infringing material upon receipt of valid DMCA notice
C. User-Generated Outputs
Users are responsible for their own published content. If a user publishes Generated Outputs that infringe third-party copyrights, Muse is not liable provided that:
- The user generated the output using Muse's analytical tools
- Muse did not create, encourage, or facilitate the infringement
- The user violated our Terms of Service in creating/publishing infringing content
However, if Muse becomes aware of infringing user-generated outputs, we may:
- Disable the user's access to that output within the Muse platform
- Issue a warning to the user
- Suspend or terminate the user's account for repeated violations
2. Reporting Copyright Infringement (DMCA Takedown Notice)
A. When to Submit a DMCA Notice
You should submit a DMCA notice if:
- A copyrighted work you own or control is being analyzed, cached, or displayed on justmuse.app without authorization
- A user has uploaded your copyrighted work to Muse without permission
- Muse's platform is directly hosting or republishing your copyrighted content
Do NOT submit a DMCA notice if:
- A user has published a Generated Output (script, hook, caption) that you believe infringes your work — this is a matter between you and that user, not a Muse platform issue
- You are disputing the terms of a license or authorized use
- You simply dislike content created by another user or generated by our AI
B. Designated Copyright Agent
All DMCA notices must be submitted to our Designated Copyright Agent:

3. Content of a Valid DMCA Notice
To be effective, your DMCA notice must include all of the following:
- Identification of Copyrighted Work:
- Title of the copyrighted work(s) claimed to be infringed
- Registration number (if registered with the US Copyright Office)
- Description of the work and how it is protected by copyright
- If multiple works, provide a list or representative examples
- Identification of Infringing Material:
- Specific URL(s) on justmuse.app where the infringing material appears
- Description of the infringing material and how it relates to your copyrighted work
- Screenshots or links to the specific page/content
- Your Contact Information:
- Full legal name and address
- Phone number (optional but recommended)
- Email address
- If submitting on behalf of a company/organization, company name and your title/authority
- Statement of Good Faith & Harm:
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, their agent, or by law
- Example: “I certify that the copyrighted work identified above is not authorized for use by Muse AI or the user who uploaded/published it.”
- Accuracy Statement & Penalty of Perjury:
- A statement made under penalty of perjury that: the information in the notice is accurate; and you are authorized to act on behalf of the copyright owner
- Example: “I declare, under penalty of perjury, that I am the copyright owner (or authorized agent) of the work(s) identified above, and the information in this notice is accurate to the best of my knowledge.”
- Digital Signature or Legal Signature:
- Your typed name (for email submission) or physical signature
- If submitting by email, include a statement like: “Signature: [Your Full Name]”
C. Format Requirements
Your DMCA notice should be:
- Written in English or include a certified English translation
- Submitted by email to support@justmuse.app with “DMCA Notice” in subject line, or
- Mailed to the address above if you prefer physical delivery
4. Muse's Response to DMCA Notices
A. Processing Timeline
Upon receipt of a valid DMCA notice, Muse will:
1. Acknowledgment (within 48 hours):
- Acknowledge receipt of your notice
- Provide a reference number for tracking
2. Investigation (within 5-7 business days):
- Investigate the claim and verify that the notice meets DMCA requirements
- Examine the allegedly infringing material
- Determine whether removal is appropriate
3. Action (within 10 business days):
- If valid: Remove or disable access to the infringing material
- If invalid/incomplete: Request clarification or reject the notice
- If unclear: Notify the user and provide opportunity for counter-notification
B. Types of Removal Actions
Depending on the nature of the infringement, Muse may:
- Remove cached video data (temporary storage for analysis)
- Delete user-uploaded files from our servers
- Remove infringing Generated Outputs from user accounts
- Disable user access to specific features or content
- Suspend or terminate user accounts for repeated violations
C. Notification to Affected Users
When we remove content due to a DMCA notice, we will:
- Notify the user whose account/content is affected
- Explain the reason for removal (copyright infringement claim)
- Provide the claimant's contact information
- Inform them of their right to submit a counter-notice (Section 5)
D. Public Record
Muse maintains a searchable database of DMCA notices received. This database is available to the public and updated regularly, in compliance with DMCA transparency requirements. Your personal information (address, phone) may be included in this public record unless you request redaction.
5. Counter-Notification Procedure (User Right to Respond)
A. When to Submit a Counter-Notice
If your content was removed due to a DMCA notice and you believe:
- The removal was made in error
- You have authorization to use the content (license, fair use, public domain)
- The copyright claimant is acting in bad faith
You may submit a Counter-Notice to challenge the removal.
B. Submitting a Counter-Notice
Your Counter-Notice must include:
- Your Contact Information: Name, address, phone number, email
- Identification of Removed Content: Description of the content that was removed; Original URL or reference number from the DMCA takedown notice
- Statement of Belief: A statement that you have a good-faith belief that the material was removed in error; Explanation of why you believe the removal was erroneous
- Basis for Authority:
- If you have authorization to use the content: describe your license or right (e.g., Creative Commons license, fair use analysis, permission from copyright holder)
- If the work is in the public domain: explain why
- If you are the copyright owner: state that you authorized the use or are reclaiming your work
- Accuracy Statement: A statement made under penalty of perjury that the information is accurate. Example: “I declare, under penalty of perjury, that I have a good-faith belief that the removal was erroneous and that I am authorized to use this content.”
- Consent to Jurisdiction: A statement that you consent to jurisdiction of the U.S. Federal Court for the district where you reside (or Delaware if you reside outside the US)

C. Counter-Notice Timeline
- Receipt & Acknowledgment (48 hours): We acknowledge receipt
- Notification to Claimant (10 days): We inform the copyright claimant that a counter-notice was filed
- Waiting Period (10-14 days): The claimant must file a lawsuit against you or we will restore the content
- Restoration (after 14 days): If no lawsuit is filed, we restore the removed content to your account
Important: This is a legal process. If the claimant files suit, we will comply with court orders.
6. Repeat Infringer Policy
A. Definition
A “repeat infringer” is a user who:
- Has received two (2) or more valid DMCA takedown notices within 12 months, or
- Has a pattern of violating copyright laws or intellectual property rights
B. Consequences
Muse reserves the right to:
- Suspend the repeat infringer's account immediately
- Terminate the repeat infringer's account without refund
- Forfeit all credits and subscription fees
- Report the infringer to law enforcement if appropriate
C. Innocent Infringement Defense
Users acting in good faith may appeal termination by demonstrating they:
- Were unaware of the infringement
- Have taken corrective measures
- Have obtained proper licenses or permissions going forward
Appeals should be submitted to support@justmuse.app with evidence of good faith and corrective action.
7. False DMCA Notices
A. Perjury & Legal Liability
Anyone submitting a DMCA notice makes statements under penalty of perjury. False or bad-faith DMCA notices are illegal and may result in:
- Civil liability to the harmed user (damages, attorney fees)
- Criminal prosecution for perjury
- Monetary damages under 17 U.S.C. § 512(f)
B. Muse's Response to Bad-Faith Notices
If Muse determines that a DMCA notice was filed in bad faith or contains false information, we may:
- Deny the notice and refuse to remove content
- Counter-sue the false claimant on behalf of the affected user
- Publicly identify the bad-faith claimant
- Report false filings to authorities
8. International Copyright & WIPO Compliance
A. Non-US Jurisdictions
For copyright holders outside the United States:
- EU Copyright Directive: Muse respects EU Directive 2019/790 (DSM Directive) and will respond to notices from EU member states
- UK Copyright Law: Muse complies with UK Copyright, Designs and Patents Act 1988
- India Copyright Act: Muse complies with the Indian Copyright Act, 1957
B. WIPO Complaints
- Domain Name Disputes: For disputes over domain ownership (justmuse.app), file a complaint with WIPO (World Intellectual Property Organization) Arbitration & Mediation Center

9. Content Moderation & Fair Use Considerations
A. Fair Use Analysis
Muse recognizes that not all use of copyrighted material constitutes infringement. Fair use may apply when content is used for:
- Commentary & Criticism: Reviewing or analyzing copyrighted works
- Educational Purposes: Teaching or scholarly research
- News Reporting: Reporting on current events
- Parody: Creating parodies of copyrighted works
- Transformative Use: Creating substantially new derivative works
Muse will not remove content solely because a DMCA notice is submitted if the use is likely protected by fair use.
B. Transformative Analysis
Muse's frame-by-frame analysis of videos to extract pacing, hooks, and retention metrics is considered transformative fair use because:
- It adds analytical value beyond the original work
- It does not substitute for the original content
- It supports commentary and education in the creator economy
- It does not harm the copyright holder's market
10. Exceptions & Limitations
A. What We Will NOT Remove Without Court Order
- User-generated scripts, hooks, or captions that reference or discuss copyrighted works (commentary/criticism)
- Thumbnails or frame grabs used for educational analysis or commentary
- Links to copyrighted content hosted elsewhere (linking is not hosting)
- AI-generated content that is inspired by but does not copy copyrighted works
B. What We WILL Remove Immediately
- Full or near-full reproductions of copyrighted video files
- Unauthorized re-publication of entire copyrighted works
- Content that directly copies substantial portions of third-party copyrighted material
- User uploads of movies, TV shows, or music without authorization
