Terms of Service

1. Acceptance of Terms

By creating an account, connecting social media handles, or subscribing to any paid plan, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Service.

Age Requirement: You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use Muse. By using the Service, you represent and warrant that you meet this requirement.

2. License & Intellectual Property Ownership

A. Your Input Content

You retain 100% full ownership and all intellectual property rights in all original content you provide to the Service, including:

• Video files, audio tracks, and visual assets uploaded for analysis
• Brand assets, persona descriptions, and creator briefs
• Social media handles, captions, and metadata

You grant Muse a limited, worldwide, non-exclusive, royalty-free, revocable license to:

• Host and process your content solely to provide the Service
• Analyze your content to generate recommendations and outputs specific to your account
• Cache publicly available social media data for analytics purposes (max 24 hours)

You remain the sole copyright holder. Muse does not claim ownership of any content you upload.

B. Generated Outputs

Subject to your compliance with these Terms and payment of applicable subscription fees, you own 100% of all copyright and intellectual property rights in the AI-generated scripts, hooks, captions, carousel text, retention breakdowns, and video recommendations produced by Muse specifically for your account (“Generated Outputs”).

You may use, publish, monetize, and distribute Generated Outputs without limitation or attribution to Muse (though mentioning Muse is appreciated).

Restriction: You may not sell, license, or redistribute Generated Outputs as a standalone product or service competing with Muse.

C. Disclaimer on AI Accuracy & Performance

You acknowledge that Generated Outputs are produced by probabilistic artificial intelligence models. Muse makes no warranties—express or implied—regarding:

• Absolute accuracy or factual correctness of generated content
• Viral performance, view guarantees, or engagement predictions
• Non-infringement of third-party copyrights, trademarks, or patents
• Suitability for any particular platform or audience

You are solely responsible for reviewing, editing, and verifying all Generated Outputs prior to publishing on social media or third-party platforms. You assume all risk associated with publishing generated content.

D. No Model Training on Private Data

Your private uploaded videos, brand personas, scripts, and account data are not used to train public foundational AI models or improve Muse's service for other users. Your content remains private and confidential.

3. Subscription Plans, Credits & Billing

A. Available Plans (India)

• Starter Plan: ₹99/month — 48 credits per month
• Pro Plan: ₹399/month — 240 credits per month (includes 90-day growth guarantee; see Section 3.G)

B. Available Plans (US & International)

• Creator Plan: $19/month — 300 credits per month
• Professional Plan: $44/month — 750 credits per month

C. Credit System

Credits are consumed as follows:

• Chat Generations: 1 credit per generation (scripts, hooks, captions, carousels)
• Video Analysis: 4 credits per analysis (frame-by-frame breakdown, pacing metrics, retention recommendations)
• Unused Credits: Credits expire at the end of each billing cycle and do not roll over. Cancelling mid-cycle forfeits unused credits.

D. Merchant of Record & Payment Processing

All billing and payment processing is handled by our Merchant of Record partners:

• India: Dodo Payments (operates as MoR for VAT/GST compliance)
• US & International: Stripe (operates as MoR for sales tax compliance)

These partners handle payment authorization and processing, tax calculation and remittance (VAT, GST, sales tax), billing inquiries, and dispute processing. You agree that Dodo Payments and Stripe are authorized to process your payment information on our behalf.

E. Auto-Renewal & Cancellation

Auto-Renewal: Your subscription automatically renews on a monthly basis at the rate you initially selected unless you cancel.

Cancellation: You may cancel your subscription at any time through your Billing Portal (Settings > Billing > Cancel Subscription) or by emailing support@justmuse.app. Cancellations take effect at the end of the current billing cycle.

Notice Requirement: To avoid renewal charges, cancel at least 24 hours before your billing date.

F. Price Changes

We may change subscription pricing with 30 days' advance notice. Continued use of the Service after notice constitutes acceptance.

G. 90-Day Growth Guarantee (Pro Plan, India Only)

The 90-day growth guarantee applies exclusively to the Pro Plan (₹399/month) in India. It means:

• You commit to implementing Muse recommendations consistently for 90 days from the date of subscription.
• If your public video performance does not improve measurably (views, engagement rate, or follower growth) after 90 days of consistent use, you may request a full refund of your 90-day subscription fees.

Conditions: You must document usage (screenshots of video posts, analytics dashboards). You must have published at least 12 videos using Muse-generated content during the 90-day period. Refund requests must be submitted within 7 days of the 90-day mark. This guarantee is voided if you violate these Terms or engage in manipulative tactics.

4. Acceptable Use & Fair Usage Policy

You explicitly agree not to:

• Reverse Engineering & Extraction: Reverse engineer, decompile, disassemble, or attempt to extract source code, model weights, prompts, algorithms, or underlying infrastructure of the Service.
• Unauthorized API Usage: Use automated scripts, bots, scrapers, or unapproved API calls to bypass rate limits, run bulk audits on third-party handles without authorization, or exfiltrate data.
• Illegal & Harmful Content: Upload, generate, or distribute content that violates applicable laws, exploits or harms minors, contains hate speech, harassment, threats, defamation, or infringes intellectual property.
• Impersonation & Deception: Falsely represent your identity, create fake accounts, or impersonate other users or brands.
• Multi-Accounting: Create multiple accounts to circumvent rate limits, evade bans, or game the credit system.

Violation of these terms results in immediate account suspension or termination without refund.

5. Limitation of Liability

A. NO WARRANTIES

THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. MUSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

B. CAP ON LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MUSE AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunity
• Any damages arising from your use or misuse of Generated Outputs

Our total aggregate liability for any and all claims shall not exceed the total amount you paid to Muse in the twelve (12) months preceding the claim. If you have not paid Muse anything, our liability is capped at $0.

6. Indemnification

You agree to indemnify, defend, and hold harmless Muse AI, its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses arising out of or relating to your violation of these Terms, your use or misuse of the Service, and any Generated Outputs you create, publish, or monetize.

7. Third-Party Platform Terms & Restrictions

A. Social Media Integration

Muse integrates with Instagram, YouTube, Threads, and other social platforms (“Platforms”). When you connect your account, you agree to comply with each Platform's Terms of Service and Community Guidelines. Muse is not responsible for content removal, account suspension, or monetization strikes by Platforms.

8. Account Termination & Suspension

Muse reserves the right to suspend or terminate your account immediately if you violate these Terms, engage in illegal behavior, or pose a security risk. You may terminate your account at any time via Settings > Account > Delete Account or by emailing support@justmuse.app.

9. Refund Policy

Monthly and annual subscription fees are non-refundable. Cancellations take effect at the end of the billing period, and no pro-rata refunds are issued for unused days or remaining credits. Exceptions are considered only for billing errors reported within 30 days or under the 90-day growth guarantee.

10. Warranty Disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, MUSE PROVIDES THE SERVICE ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. MUSE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. You assume all risk associated with your use of the Service.

11. Changes to Terms & Service

We may modify these Terms at any time by posting updated Terms on the Service. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms. We may also discontinue, modify, or suspend the Service at any time.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Delaware, United States. Disputes will be resolved via binding individual arbitration administered by JAMS or AAA in New York, NY. Class action lawsuits are not permitted.

Indian Users: Claims arising under Indian consumer protection law or the DPDP Act may be filed with the competent consumer court or Data Protection Board of India.

13. Entire Agreement & Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muse. If any provision is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
